Welcome to Get Day AI. These Terms and Conditions ("Terms") govern your use of getdayai.com (the "Site"), our services, and any communications with us, including SMS/text messaging. By using the Site or our services, you agree to these Terms.

1. Who We Are

Get Day AI is a service of Dr. Nova Day LLC, a Georgia limited liability company based in Marietta, Georgia.

2. Services

Get Day AI provides AI-powered business services including but not limited to: AI receptionists and voice agents, AI Search Visibility (GEO) audits and services, workflow automation, AI prospecting systems, business planning, revenue projections, acquisitions consulting, speech writing and speaker tools, and grant writing services. Specific service terms are provided in your service agreement or engagement letter.

3. Use of the Site

You agree to use the Site only for lawful purposes. You may not:

Attempt to access unauthorized areas
Interfere with site security or operations
Use the Site to send spam, harass, or violate any law
Scrape, copy, or replicate site content without permission

4. SMS Messaging Terms

If you provide your phone number and opt in to SMS via our website chat widget, consent is required and is granted separately for each message category. Transactional/customer-care consent and promotional/marketing consent are collected via independent checkboxes — checking one does not enroll you in the other.

Message frequency varies. Transactional messages are sent as needed in response to your inquiry; marketing messages (only if separately opted in) are typically 1 to 4 per month.
Message and data rates may apply based on your mobile carrier plan.
Opt out anytime by replying STOP. Reply HELP for support, or contact us at hello@getdayai.com.
Consent to receive SMS is not a condition of purchasing any goods or services.
Carrier disclaimer: message delivery depends on your carrier; Get Day AI is not responsible for messages that fail to deliver due to carrier issues.

5. Payment Terms

Services are billed as described in your service agreement. Consulting and setup fees are typically due before service begins. Recurring subscriptions renew automatically until canceled. Refunds are handled per your service agreement.

6. Property Deal Analysis

Get Day AI offers AI-powered property deal analyses for U.S. properties only. Each analysis is delivered by email within 3 business days of receiving the property address (5 business days per property for the 5-Deal Pack). Packs must be used within 90 days of purchase; unused analyses expire after that date. Deal analyses are for informational and educational purposes only. They are not appraisals, broker price opinions, or statements of market value, and are not legal, tax, or investment advice. Get Day AI does not receive commissions or fees tied to any property transaction.

Refunds: a full refund is available if requested before an analysis is delivered. Delivered analyses are non-refundable.

7. Intellectual Property

All content on the Site — including text, graphics, logos, images, software, and AI agent training data developed by Get Day AI — is the property of Get Day AI / Dr. Nova Day LLC or licensed to us. You may not use, copy, or distribute without written permission.

Deliverables produced for you under a service agreement are governed by that agreement. Our proprietary systems, frameworks, and methodologies (including but not limited to the Revenue Loss Audit, the 5D Framework, AI receptionist architectures, and the MIND Reset™ framework) remain our property.

8. Third-Party Services

The Site and services may integrate with third-party platforms (currently GoHighLevel/GrowthHub365, Twilio, Google, Shopify, and others, subject to change). Your use of those platforms is governed by their own terms.

9. Disclaimers

No guarantee of results. AI services provide tools and systems; business results depend on many factors beyond our control. We do not guarantee specific revenue, lead volume, or business outcomes unless explicitly stated in a service agreement.

Site provided "AS IS." We make no warranties, express or implied, about the Site's availability, accuracy, or fitness for a particular purpose.

10. Limitation of Liability

To the maximum extent permitted by law, Get Day AI / Dr. Nova Day LLC is not liable for indirect, incidental, consequential, or punitive damages. Our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify Get Day AI / Dr. Nova Day LLC against claims arising from your misuse of the Site or violation of these Terms.

12. Termination

We may suspend or terminate access to the Site or services at any time for violations of these Terms or applicable law.

13. Governing Law

These Terms are governed by the laws of the State of Georgia, USA. Disputes will be resolved in the state or federal courts located in Cobb County, Georgia.

14. Changes to Terms

We may update these Terms from time to time. Continued use of the Site after changes constitutes acceptance.
